IN THE SUPREME COURT OF NEW SOUTH WALES- PROBATE JURISDICTION.- In the Will of EDWARD ATKINS THE ELDER, late of "Mount Pleasant" Ermington, in the State of New South Wales, Freehoilder, deceased. APPLICATION will be made after fourteen days from the publication hereof that Probate of the last Will of the above named deceased may be granted to JOSEPH STEVENS (in the said Will called Joseph Stevens), and EDWARD MILLER, both of Ermington aforesaid, orchardists, the Executors named in the said Will. All persons having any claim against the Estate of the said deceased are required to render the same to the said Applicants within fourteen days aforesaid, and all notices may be served at the office of CHARLES ERNEST BYRNES, Proctor for the Applicants, George Street, Parramatta.

This is the last Will and Testament of me Edward Atkins the elder of Mount Pleasant Ermington in the State of New South Wales Freeholder I appoint Joseph Stephens of the Field of Mars in the said State, Fruitgrower and Edward Miller of Ermington in the said State Orchardist Trustees and Executors of this my Will I give and bequeath all my household furniture, plate, linen, china, books, pictures, musical instruments and other household effects in and about my dwelling house at the time of my decease including any ready money in the house or in any bank or banks or wheresoever the same might be unto my wife Jemima Mason Atkins absolutely. I also give and bequeath my pony carriage and harness and any other personal property of mine to my wife absolutely. I devise all my real estate wheresoever situated unto my Trustees and their heirs Upon Trust to sell the same and after payment thereout of all my just debts funeral and testamentary expenses to divide the proceeds thereof between and amongst my said wife and my children namely Edward Atkins, William Alfred Atkins, George Atkins, Louisa Small wife of Joseph Small, Emma Lockwood wife of Frederick Lockwood of Granville, Helena Tovey wife of George Tovey of Parramatta and to Clara Elizabeth Kerrlery wife of Thomas Kerrlery of Liverpool in equal shares and proportions In the event of my orchard adjoining my said dwelling house Mount Pleasant being untenanted I direct that my said trustees shall keep the same in order until sale and charge the upkeep thereof to the proceeds of the sale thereof I direct and declare that the share and interest of every female beneficiary under this my will shall be for her sole and separate use and benefit independent of and free from the debts engagements interference and control of any husband with whom she may intermarry and that her receipts alone whether covert or alone shall be a good discharge for any money paid to her I direct and declare that if any of my said children shall predecease me the share or shares of him, her or them so dying to go to and be divided between and amongst the survivor or survivors in equal shares and proportions I authorise and empower my said Trustees or Trustee to let or lease any part of my real property (except my said dwelling house Mount Pleasant) for any term not exceeding one year from the date of my decease upon such terms and conditions as they shall think fit and stand possessed of the rents of the rents upon the same trusts as are heretofore declared regarding the proceeds of the sale thereof. I authorise and empower my said Trustees or Trustee to sell all my real Estate by public auction or by private contract either together or in parcels with power to ins*** any special or other stipulations in any contract or conditions of sale as to title or otherwise as they or he may think proper In Witness whereof I have hereunto set my hand this eleventh day of June in the year one thousand nine hundred and five
