His Majesty's 7th Batt of Regiment of Foot whereof General Sir A Clarke is Colonel.
These are to certify that Elijah Freshwater Private in Captain Archer's Company in the Regiment aforesaid, is the County of Cambridge was enlisted at the Age of 17 years; and hath served in the said Regiment for the Space of two years and 203 Days, as well as in other Corps, after the Age of Eighteen, according to the following Statement, but in consequence of a Gun Shot wound of the hand in Spain (16 May 1811) is considered unfit for further Service, and is hereby discharged, having first received all just Demands of Pay, Clothing &c. from his Entry into the said Regiment, to the Date of his Discharge, as appears by the Receipt on the Back hereof.
And to prevent any improper Use being made of this Discharge, by its falling into other Hands, the following desription of the said Elijah Freshwater. He is about 20 Years of Age, is 5 Feet 8 Inches in height, Light Hair Grey Eyes Fresh Complexion and by Trade a Labourer.

I Elijah Freshwater do acknowledge that I have received all my Clothing, Pay Arrears of Pay, and all just Demands whatsoever, from the Time of my enlisting in the Regiment mentioned on the other Side, to this Day of my Discharge.

I do hereby certify that the Cause which has rendered it necessary to discharge the within-mentioned Elyjah Freshwater as stated on the opposite side, has not arisend from Vice or Miscounduct, and that he is not, to my Knowledge incapacitated by the Sentence of General Court Martial from receiving his Pension.

The Lincoln, Rutland, and Stamford Mercury, Friday, July 27, 1849 Cambridge Assizes July 23 Alleged Church-rate Riot and Melbourn.-On Tuesday, R. Howard, a farmer, J. Campkin, a grocer, C. Baker and Elijah Freshwater, labourers, were charged with conspiring to obstruct the execution of a warrant of distress on the goods of the Rev. A. C. Wright, of Melbourn, Dissenting Minister, for the sum of 7 1/2 d. for church-rate and 14s. costs, and also for a riot. Mr. W. Cooper and Mr. Metcalfe appeared for the prosecution; and Mr. Prendergast for Baker and Freshwater. At the close of the case for the Crown Chief Justice Wilde did not "think it necessary to proceed with the case, and considerable disappointement was felt by the crowded court at the loss of the speeches of the defendant's counsel. The prisoners were aquitted on all the counts; viz., first, a conspiracy to obstruct a levy, with rioting; secondly, a without a riot,; thirdly a riot to obstruct, without a conspiracy; and, fourthly, a riot and unlawful assembly generally. The Chief Justice said, as there was not obstruction and no alarm, the jury must aquit the prisoners. It was however, a very proper case to bring before a jury, and the Court would, therefore, allow the expenses of the prosecution. Thus ended (says the Times) the great church-riot, in prosecuting which at least 40 gunieas' worth of fees were expended.
