Timothy Lees and Richard Lees, natives of the Colony, were indicted for stealing one bushel of wheat and one bag, the property of William Dawes, at Penrith, in January-last. HE WOULDN'T "CHEESE" IT.\emdash A man named Timothy Lees was brought up by Chief Constable Davis on Wednesday, Dec. 19th, charged with being drunk the night previous. He appears to have been on his way to Sydney with a load of cheese, of which he was part proprietor. Upon his arrival at Bathurst he thought proper to get drunk, and in consequence, capsized his dray in the Creek, near the Factory fall. Leaving it there in charge of an individual, named George Brown, a stranger whom he had accidentally met on the road, he returned to the town, for the purpose, as appears, of enjoying himself, when he was discovered in a state of beastly intoxication, and taken to Finnerty's general receiving house. Brown, the person left in charge of the dray and property, followed the example of the owner, and the property was therefore committed to the care of the community at large, some of whose less scrupulous members would, no doubt, have improved the opportunity for their own personal advantage, had it not been for the services of two policemen who were placed in charge of the dray and cheese during the night. When the dray came to be overhauled on the following morning, it was discovered that property to the value of about £4 had been abstracted, doubtlessly during the time the owner left it unprotected. Lees was brought up on Wednesday before E. Parkes, Esq., and fined 10s. and costs. George Brown, the person mentioned in the last paragraph as having charge of the dray and cheese during the absence of the owner, was brought up by Constable Finnerty for drunkenness. His Honor said that in this case (here had been an attempted alienation of property by insolvent to his son. The property, however, had been restored to the estate, but it had only been on the coercion of these proceedings ; and though it might possibly have been done through ignorance more than actual wrongdoing, yet he (his Honor), must mark his sense of the wrongdoing.
