DISCREDIT ON
BANKRUPT
Judge Critical
"This is a matter which reflects a good deal of discredit on the debtor, and had it been brought up much earlier I would have been inclined to refuse the application for discharge." said Judge Paine in
the Bankruptcy Court today, dealing with the case of Oliver Arthur Gransden farm laborer of Snowtown formerly greengrocer, of Crystal Brook.
Gransden's estate was sequestrated on his own petition on October 13, 1930 unsecured liabilities being £490 Assets had realised £4/17/9. He had attributed his position to falling off in business and sickness. The Official Receiver (Mr Burns) reported that in his opinion bankruptcy was due primarily to lack of capital
His Honor granted a discharge, suspended for 12 months. He said that Gransden went into business
with small capital and carried on in a slack manner without books.
Gave Assets to Wife
While that was reprehensible enough, the worst action was the handing over to his wife of the assets of the business when he must have known that he was in solvent. She sold the assets for about £170 of which only £74 reached the creditors. He regarded with suspicion the allegation that the transfer was made in consideration of £100 she had advanced him.
The transfer would undoubtedly have been an undue preference and under circumstances from which it could have been strongly inferred to have been fraudulent.
Bankrupt had been before the court for 11 years, and it was extremely unlikely that the creditors would get anything further.
